Our Divorce Practice
If you and your spouse have reached an agreement on all issues, we will draft an agreement setting forth these terms and file it in your uncontested divorce proceeding. We also handle contested divorces, when parties require assistance reaching agreement on all or some matters, or need to go to court to finalize the divorce.
We work with men and women at all stages of a divorce, from the decision to file through trial and post-judgment requests for modification or enforcement of existing divorce decrees. We handle many matters related to or arising out of divorce, including:
- Child custody: We represent parents, grandparents and relatives in custody matters, whether the parents are divorcing or are unmarried. We help parties understand the differences between physical custody and legal custody and establish and implement custody arrangements that are in their children's best interests while protecting their rights as parents.
- Child support: We will review any proposed child support order to ensure that it complies with Georgia's guidelines and that all relevant income has been factored into the calculation. We provide counsel to parents who are divorcing, as well as unmarried parents. We handle temporary support orders, final support orders, and requests for child support modification or enforcement of an existing child support order.
- Division of marital debts and assets: We will help you equitably distribute the debts and assets of your marriage, including real estate, loans and mortgages, bank accounts and investments, credit card debt and business assets. We will also prepare a qualified domestic relations order (QDRO) to help you distribute the proceeds of a retirement plan.
- Legitimation actions: We represent men who seek visitation rights with children they have fathered outside of wedlock. In Georgia, you may be shouldered with child support obligations and yet have no right to visitation, unless you bring a legitimation action and the court issues an order giving you parental rights.
We also prepare separate maintenance agreements for parties wishing to separate but not divorce. A separate maintenance agreement can protect your property interests from your spouse and from creditors.
